Unsafe Access and Egress

OSHA 29 CFR 1926 Subpart L — Scaffolding — is the federal standard governing scaffold design, construction, use, and dismantling in construction. It is one of the most frequently cited OSHA construction standards, generating 6,596 violations in FY2024 (the #3 most-cited standard). Subpart L has four key sections: 1926.451 (general requirements for all scaffolds — capacity, platform construction, access, use, fall protection, falling object protection, electrical hazards); 1926.452 (additional requirements for specific scaffold types); 1926.453 (aerial lifts — boom trucks, scissor lifts); and 1926.454 (training requirements). The standard applies to all scaffolds used in construction, alteration, repair, painting, cleaning, and pointing of buildings and structures on Texas job sites.
OSHA 1926.451(a)(1) requires that each scaffold and scaffold component be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it. Suspension ropes must support at least 6× the maximum intended load (1926.451(a)(3)). The scaffold must be erected and loaded within the rated load limits specified by the scaffold manufacturer or a qualified person. In practice: if your crew, tools, and materials total 2,000 lbs on a section, that scaffold must be rated for at least 8,000 lbs. The most common capacity citation involves crews adding materials without calculating total load. Your scaffolding safety plan must include a load calculation section for each scaffold setup — signed by the competent person before use.
OSHA 1926.451(g) requires fall protection for employees on scaffold platforms 10 feet or more above a lower level. Two options are allowed: (1) Guardrail systems — toprail at 38–45 inches above the platform, midrail halfway between toprail and platform, toeboards where falling objects are a hazard. Toprails must withstand 200 lbs applied downward or outward. (2) Personal fall arrest systems (PFAS) — full-body harness, shock-absorbing lanyard or SRL, and a properly rated anchorage (5,000 lbs minimum). OSHA 1926.451(e)(9) requires erection, moving, dismantling, or alteration only under supervision of a qualified person (for design) and competent person (for supervision). OSHA 1926.454(b) requires scaffold erectors and dismantlers be trained by a competent person in hazard recognition specific to erection and dismantling. A scaffold competent person must have: knowledge of scaffold design principles and Subpart L requirements; ability to identify existing and predictable hazards; and authority to stop work if unsafe conditions exist. OSHA 1926 Subpart L does not use the phrase "scaffolding safety plan," but several documentation requirements collectively create the need for one: (1) Competent person designation — written identification of your competent person and their qualifications (1926.454). (2) Pre-shift inspection records — written log of each inspection, conditions, and corrective actions (1926.451(f)(3)). (3) Load calculations — capacity verification for each scaffold setup. (4) Training records — documentation that scaffold users and erectors received required training (1926.454). Beyond OSHA minimums, Houston GCs routinely require a written scaffolding safety plan as part of subcontractor prequalification and SSSP submission. A written plan is also your primary defense in an OSHA investigation — absence of documentation is treated as absence of compliance.
